Attorney General Chris Carr released the following statement after the United States District Court for the Eastern District of Texas granted summary judgment in favor of 21 states who challenged the United States Department of Labor Overtime Rule. The ruling invalidated the 2016 rule.

“This is an exemplary effort by the States to stop the previous administration from defying Congress and implementing its own agenda rather than following the law,” said Attorney General Chris Carr. “We are proud to have been a part of this multi-state effort.”

Georgia was part of a 21-state coalition that challenged the U.S. Department of Labor’s Overtime Rule in federal court. If applied, this unlawful overreach likely would have forced many businesses and state and local government entities to substantially increase employment costs, eliminate services and even lay off employees.  

In addition to Georgia, the lawsuit included: Alabama, Arizona, Arkansas, Indiana, Iowa, Kansas, Kentucky, Louisiana, Maine, Michigan, Mississippi, Nebraska, New Mexico, Nevada, Ohio, Oklahoma, South Carolina, Texas, Utah and Wisconsin.
